About YSMnation

YSMnation (Young Success Makers) provides educational programs, workshops, and enrichment activities for children and youth. Founders Lab is our flagship summer entrepreneurship program for kids in grades 1–8.

02 • Safety

Assumption of Risk

I understand that participation in any youth program involves some risk. These risks may include, but are not limited to: minor cuts, scrapes, bruises, slips, falls, allergic reactions, illness, emotional discomfort, conflicts with other participants, sun exposure, weather-related discomfort during outdoor activities, or accidents involving age-appropriate materials, supplies, or tools.

YSMnation will make reasonable efforts to provide a structured, supervised, and age-appropriate program environment. However, I understand that no program can eliminate all risks, and I knowingly accept these risks on behalf of my child.

03 • Health

Health & Communicable Disease Acknowledgment

I understand that group programs involve close interaction with other children and adults, and that exposure to communicable illnesses (including but not limited to colds, flu, COVID-19, strep, hand-foot-mouth disease, lice, and other contagious conditions) is an inherent risk that cannot be fully eliminated.

I agree to keep my child home if they show signs of contagious illness, including fever within the past 24 hours, vomiting, or active symptoms. I agree to notify YSMnation promptly if my child is diagnosed with a communicable illness after attending the program so other families can be informed.

YSMnation will follow reasonable hygiene practices and may, at its discretion, adjust program protocols in response to public health guidance.

04 • Medical

Medical Authorization

In the event of illness, injury, or emergency, I authorize YSMnation staff or representatives to contact me and/or the emergency contact listed on my child's registration form.

If I cannot be reached promptly, I authorize YSMnation staff or representatives to seek emergency medical care for my child when reasonably necessary, including calling 911, transporting my child to a medical facility, or administering basic first aid.

I understand that I am solely responsible for any medical expenses related to such care, including ambulance, hospital, or treatment costs.

I confirm that the medical information I provide during registration is accurate and complete to the best of my knowledge.

05 • Disclosure

Special Needs & Medical Disclosure

I affirm that I have disclosed on the registration form (or in subsequent written communication with YSMnation) all relevant information about my child, including but not limited to:

I understand that full disclosure is required so YSMnation can make reasonable accommodations and provide appropriate supervision. I acknowledge that failure to disclose relevant information may affect YSMnation's ability to keep my child safe, and YSMnation is not responsible for outcomes resulting from undisclosed conditions or needs.

How we handle this information: All medical and personal information is treated confidentially and shared only with staff members directly responsible for your child's care.

06 • Liability

Release of Liability

To the fullest extent permitted by law, I agree to release, waive, discharge, indemnify, and hold harmless YSMnation (Young Success Makers), YSM Nation LLC, its owners, directors, officers, instructors, staff, volunteers, contractors, partners, host location, landlords, and representatives from any and all claims, losses, damages, injuries, demands, lawsuits, or expenses arising out of or related to my child's participation in Founders Lab or any YSMnation program.

This release applies to claims connected with ordinary risks associated with participation in the program. This release does not apply to claims arising from gross negligence, willful misconduct, intentional misconduct, or any conduct that cannot legally be waived under applicable law.

I sign this release on behalf of myself, my child, my heirs, executors, administrators, and any others claiming through me.

07 • Damages Cap

Limitation of Damages

To the maximum extent permitted by law, I agree that any liability of YSMnation, YSM Nation LLC, or its representatives related to my child's participation in any program shall be limited to the total amount of fees paid by me for the specific program in question.

YSMnation shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of opportunity, emotional distress, or future earnings, regardless of the legal theory under which such damages are sought.

08 • Belongings

Personal Belongings

I understand that my child is responsible for any personal items brought to the program. YSMnation is not responsible for lost, stolen, or damaged personal belongings.

Parents are encouraged to label personal items and avoid sending valuables that are not needed for the program.

09 • Media

Photo and Media Permission

During registration, parents/guardians will be asked to select a media permission option (opt-in or opt-out).

If I give media permission: I authorize YSMnation to photograph or record my child during program activities and to use those images or videos for program highlights, website content, social media, promotional materials, recap materials, or educational purposes. I understand that I will not receive compensation for these uses.

If I do not give media permission: YSMnation will not use my child as the featured subject of any promotional photo, video, or marketing material. I understand that group photos or event images may sometimes include my child incidentally in the background. YSMnation will make reasonable efforts to respect my media preference but cannot guarantee zero incidental presence in group imagery.

I may withdraw media permission at any time by emailing [email protected]. Withdrawal applies to future uses; previously published materials may remain in circulation.

10 • Market Day

Market Day Participation

I understand that Founders Lab may include a Market Day, showcase, or presentation where students may display, pitch, or sell student-created products or business ideas to family, friends, and community members.

I understand that students receive guidance during preparation, but parents/guardians are responsible for reviewing and approving their child's product idea, materials, pricing, and participation.

YSMnation reserves the right to restrict or prohibit any product that is, in its sole discretion:

I understand that any money collected at Market Day from sales of student products is earned by my child as part of an educational entrepreneurship exercise. YSMnation does not take a percentage and is not responsible for tracking, holding, or returning student funds.

11 • Conduct

Code of Conduct

Founders Lab is designed to be a safe, respectful, creative, and encouraging environment where every student can learn, build, and grow with confidence.

By registering, parents/guardians agree to review these expectations with their child before the program begins.

Student Expectations

  1. Treat instructors, staff, volunteers, classmates, guests, and the program space with respect.
  2. Use kind and appropriate language.
  3. Follow directions from program staff.
  4. Participate positively in lessons, group work, projects, and activities.
  5. Respect other people's ideas, even when they are different from their own.
  6. Keep hands, feet, and objects to themselves.
  7. Use supplies, tools, equipment, and materials safely and responsibly.
  8. Stay with the group and remain in approved program areas.
  9. Help keep the program space clean and organized.
  10. Practice honesty in projects, teamwork, presentations, and Market Day activities.

Behavior That Is Not Allowed

12 • Devices

Technology and Devices

Phones, tablets, computers, and other electronic devices may only be used when allowed by program staff.

Students may not use devices to distract others, access inappropriate content, record other students, take photos without permission, or post program content without approval.

YSMnation is not responsible for lost, stolen, or damaged electronic devices brought to the program.

13 • Parents

Parent/Guardian Responsibilities

  1. Provide accurate registration, emergency contact, allergy, and medical information.
  2. Drop off and pick up their child on time.

  9. Pay program fees on time and in accordance with the published refund policy.
14 • Logistics

Drop-off & Pick-up

Drop-off begins at 8:50 AM. The program runs from 9:00 AM to 3:00 PM, Monday through Friday. Pick-up starts by 2:55 PM and ends by 3:10 PM.

Only authorized adults listed on the registration form may pick up a child. A valid photo ID may be requested. If someone outside the authorized list will be picking up a child, parents must notify YSMnation in writing in advance.

Late pick-up fee: If a child is not picked up by 3:15 PM, a late fee of $30 per 15 minutes will be charged. Repeated late pick-ups (3 or more) may result in dismissal from the program without refund.

If a child remains unattended at the venue past 30 minutes after dismissal and the parent cannot be reached after reasonable efforts, YSMnation may contact local authorities for assistance.

15 • Discipline

Discipline and Dismissal Policy

If a student has difficulty following the Code of Conduct, YSMnation staff may take appropriate steps based on the situation.

These steps may include reminders, redirection, parent/guardian contact, removal from an activity, early pickup, suspension from the program, or dismissal from the program.

YSMnation reserves the right to remove a student from the program if their behavior creates a safety concern, disrupts the learning environment, damages property, or negatively affects the experience of other students.

Refunds are not provided if a student is removed from the program due to behavior that violates the Code of Conduct.

16 • Fit

Fit Assessment Window

YSMnation reserves the right to observe and assess each child during the first three (3) days of any cohort to determine whether the program is a good fit for that child's needs and the group's overall experience.

If, after the assessment window, YSMnation staff determines in good faith that the program is not an appropriate fit — for reasons including but not limited to undisclosed support needs, behavioral concerns, or safety considerations — YSMnation may ask the parent/guardian to withdraw the child from the program.

In such cases, YSMnation will offer a prorated refund for the unused portion of the program.

17 • Force Majeure

Force Majeure & Program Changes

If YSMnation must cancel, postpone, shorten, or modify a program due to circumstances beyond its reasonable control — including but not limited to natural disasters, severe weather, public health emergencies, government orders, loss of venue, utility failures, acts of terrorism, or other unforeseen events — YSMnation will make reasonable efforts to reschedule or provide alternative arrangements.

In the event of cancellation due to force majeure, YSMnation may, at its sole discretion, offer credits toward future programs in lieu of cash refunds. YSMnation is not obligated to provide cash refunds for cancellations or modifications caused by circumstances beyond its reasonable control.

18 • Governing Law

Governing Law & Dispute Resolution

This agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws principles.

Any dispute, claim, or controversy arising out of or relating to this agreement, my child's participation in any YSMnation program, or the breach thereof, shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and I consent to the personal jurisdiction of those courts.

Both parties agree to first attempt to resolve any dispute through good-faith communication before pursuing legal action.

19 • Severability

Severability & Entire Agreement

If any provision of this agreement is found by a court of competent jurisdiction to be invalid, unenforceable, or contrary to law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be made enforceable, it shall be severed from this agreement. All other provisions of this agreement shall remain in full force and effect.

This agreement, together with the program registration form, refund policy, and any written communications between YSMnation and the parent/guardian, constitutes the entire understanding between the parties regarding my child's participation in YSMnation programs and supersedes any prior verbal or written agreements.
